These Terms are between you and Louis Krudo, doing business as Louis Krudo Jewelry, 638 Spartanburg Hwy, Ste 70-350, Hendersonville, NC 28792. Email: info@louiskrudo.com.

Louis Krudo Jewelry is one person. Every piece is designed, created and handcrafted by Louis Krudo alone. In these Terms, "we," "us," and "our" mean Louis Krudo.

1. ACCEPTANCE OF TERMS

Welcome to Louis Krudo Jewelry ("we," "us," or "our"). These Terms and Conditions ("Terms") govern your use of our website, products, services, and any digital properties we own or control (collectively, the "Site"). By accessing or using our Site, purchasing our products, or engaging with our content, you agree to be bound by these Terms.

If you do not agree, you must not access the Site, purchase our goods, or use our services.

2. ELIGIBILITY

To use our Site or place an order, you must be at least 18 years of age, or the age of majority in your jurisdiction, whichever is older. By using our Site, you affirm that you meet this requirement. If you are using our Site on behalf of a business or legal entity, you confirm you are authorized to bind that entity to these Terms.

3. PRODUCTS AND SERVICES

Louis Krudo personally designs and handcrafts every piece of bold jewelry for those who don’t shy away from power, presence, or style. Every piece is subject to availability and is made with materials, textures, and finishes that are rugged by design. We reserve the right to modify, discontinue, or limit any product or service without notice.

While we aim to accurately represent all items, we do not guarantee that colors, finishes, or dimensions will appear exactly as seen on your screen. Variations may occur due to screen settings, lighting, or the handcrafted nature of our pieces.

4. PRICING & PAYMENT TERMS

All prices are in USD and are exclusive of taxes and shipping unless stated otherwise. We reserve the right to change prices at any time. Once you place an order, that price is locked in.

We accept major credit cards, debit cards, and other payment methods displayed at checkout. You authorize us to charge your selected payment method for the full amount of your purchase, including taxes, shipping, and any applicable fees.

5. SHIPPING & DELIVERY

Every piece is handmade to order and ships within 12 weeks of payment, to US addresses only. Carrier transit times after shipping are not guaranteed. Full details are in our Shipping Policy.

6. RETURNS & EXCHANGES

Cancellations, returns, ring sizes and repairs are set out in our Refund Policy (Orders, Cancellations, Returns & Ring Sizes).

7. RESALE AND USE OF OUR NAME

You may resell a piece you own. You may not use the Louis Krudo name, logo, designs or photographs, or sell copies of our designs, without our written permission.

8. USER CONTENT (REVIEWS, SOCIAL TAGGING)

If you submit reviews, testimonials, images, or tag us in social content:

  • You grant Louis Krudo Jewelry a non-exclusive, royalty-free, perpetual license to use, modify, display, or distribute your content
  • You confirm that your content is your own, and does not infringe on any third-party rights
  • We reserve the right to use or not use your content at our discretion

You agree not to submit content that is defamatory, discriminatory, misleading, or in violation of any laws.

9. INTELLECTUAL PROPERTY RIGHTS

All content on the Site — including but not limited to product designs, photographs, videos, text, trademarks, logos, graphics, page layouts, and code — is the exclusive property of Louis Krudo Jewelry or its licensors. All rights are reserved.

You may not:

  • Copy, reproduce, or distribute our content without written permission
  • Use our trademarks or logos in any manner that implies endorsement without a licensing agreement
  • Create derivative works based on our designs or product images

Any unauthorized use constitutes infringement and will be prosecuted under applicable U.S. and international copyright, trademark, and trade dress laws.

10. COPYRIGHT COMPLAINTS (DMCA POLICY)

If you believe your intellectual property rights have been infringed, email a DMCA Takedown Notice to info@louiskrudo.com with the subject line "DMCA Complaint".

Your notice must include:

  1. A description of the copyrighted work claimed to be infringed
  2. The URL or location of the infringing content
  3. Your contact information
  4. A statement under penalty of perjury that you own the rights or are authorized to act on behalf of the owner
  5. Your physical or electronic signature

We reserve the right to remove alleged infringing content and terminate repeat infringers.

11. PRODUCTS AND THIS WEBSITE

Each piece is made of the metals stated in its description. The website itself is provided “as is”; we do not warrant that the Site will be uninterrupted, secure, or error-free.

12. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Louis Krudo (Louis Krudo Jewelry) is not liable for:

  • Any indirect, incidental, special, or consequential damages
  • Loss of profits, revenue, data, goodwill, or business opportunities
  • Any injury or damage resulting from the use or misuse of our products

Our total liability, whether in contract, warranty, tort (including negligence), or otherwise, will not exceed the amount you paid for the product giving rise to the claim.

13. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Louis Krudo (Louis Krudo Jewelry) from and against any claims, damages, liabilities, losses, costs, or expenses (including attorneys’ fees) arising out of:

  • Your breach of these Terms
  • Your misuse of the Site or products
  • Your violation of any applicable law or third-party rights

We reserve the right to assume exclusive defense and control of any matter subject to indemnification.

14. DISPUTE RESOLUTION – MANDATORY ARBITRATION

You agree that any dispute or claim relating to your use of the Site or purchase of our products will be resolved by binding arbitration under the rules of the American Arbitration Association (AAA).

  • Arbitration will take place in North Carolina, USA
  • Each party is responsible for its own legal fees unless otherwise awarded by the arbitrator
  • Class action lawsuits, jury trials, and other court proceedings are waived in favor of arbitration

This provision does not prevent either party from seeking temporary or preliminary injunctive relief.

15. FORCE MAJEURE

We are not responsible for any failure to perform due to causes beyond our reasonable control, including but not limited to:

  • Natural disasters (fire, flood, earthquake)
  • Acts of God
  • War, terrorism, labor disputes
  • Epidemics, pandemics, or government restrictions
  • Supply chain interruptions

17. PRIVACY & DATA PROTECTION

Your privacy matters to us. Our Privacy Policy governs the collection, use, and protection of your personal data. Key points:

  • You may request access to, correction of, or deletion of your data at any time

18. GOVERNING LAW

These Terms are governed by the laws of North Carolina, United States, without regard to conflict of law principles. Any legal action must be brought in the federal or state courts located in North Carolina.

19. SEVERABILITY

If any provision of these Terms is found invalid, unlawful, or unenforceable, the remaining provisions will remain in full force.

20. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, Shipping Policy and Refund Policy (Orders, Cancellations, Returns & Ring Sizes), are the entire agreement between you and us regarding the Site and products. They supersede all prior agreements, written or oral.

21. CHANGES TO TERMS

We may revise these Terms at any time without notice by updating this page. Your continued use of the Site after changes are posted means you accept the revised Terms.
